This Site is a platform dedicated to transportation and urban planning enthusiasts. This Site operates the transportation and urban planning platform known as 'Cities:Designers' at www.citiesdesigners.com.

Unless otherwise indicated, all original content published and made available on our Site — including but not limited to logos, UI design, graphics, modeling mechanics, platform features, and original data models — is the property of InfiniteDimensional LLC and protected by applicable intellectual property laws. Unauthorized reproduction, distribution, or commercial use of such original content is strictly prohibited.

Certain content on this Site is sourced from third parties and remains subject to the intellectual property rights of their respective owners. This includes map data provided by OpenStreetMap (© OpenStreetMap contributors, ODbL) and AMap, as well as publicly available datasets. We make no claim of ownership over such third-party content.

Age Restrictions
The minimum age to use our Site is 16 years old. By using this Site, users agree that they are over 16 years old. We do not assume any legal responsibility for false statements about age.

Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

InfiniteDimensional LLC and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless InfiniteDimensional LLC and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of the State of California.

Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and InfiniteDimensional LLC are unable to resolve any dispute through informal discussion, then you and InfiniteDimensional LLC agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and InfiniteDimensional LLC. The costs of any mediation or arbitration will be paid by the unsuccessful party.

Notwithstanding any other provision in these Terms and Conditions, you and InfiniteDimensional LLC agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement. All disputes shall be resolved on an individual basis. You waive your right to participate in any class action lawsuit or class-wide arbitration against InfiniteDimensional LLC.

Additional Terms

• We are not responsible for the acts, omissions, errors, or outages of any third-party service providers used by the platform, including but not limited to Supabase, Tencent Cloud, OpenStreetMap, AMap, and where optional AI-assisted features are enabled, Hugging Face or other inference providers;
• We do not guarantee uninterrupted or error-free access to the platform. We reserve the right to suspend, modify, or discontinue any part of the service at any time without prior notice;
• Our use of cookies and tracking technologies is governed by our Privacy Policy, which forms part of these Terms;
• By creating and saving content (including subway routes and maps) on the platform, users grant InfiniteDimensional LLC a non-exclusive, royalty-free license to store, display, and process that content solely for the purpose of providing the service;
• The platform is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement;
• In no event shall InfiniteDimensional LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, even if we have been advised of the possibility of such damages;
• We reserve the right to suspend or permanently terminate any user account at our sole discretion, with or without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties;
• We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government action, internet outages, or third-party infrastructure failures;
• These Terms, together with our Privacy Policy, constitute the entire agreement between you and InfiniteDimensional LLC regarding your use of the platform, and supersede all prior agreements, representations, or understandings; and
• Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision in the future.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We may notify users of material changes to these Terms and Conditions by email or by posting a notice on our Site. It is your responsibility to review these Terms and Conditions periodically.    2. Using IP address data for aggregated marketing analytics to better understand our user base and improve our services.
   
   3. Detecting the user's system language settings to automatically provide the most suitable default interface language.
   
   4. Sending newsletters to registered users to share platform updates and new features.; and
3. Processing of user personal data is necessary for us to take, at the request of a user, steps before entering a contract or for the performance of a contract to which a user is a party. If a user does not provide the personal data necessary to perform a contract the consequences are as follows: - Without an email address: the user cannot create an account or access platform features such as building and managing subway routes. They will also not receive newsletters or platform updates.
   
   - Without IP address data: the user may not receive region-optimized map services and the platform may not display the most appropriate default language.

Personal Data We Collect
We only collect data that helps us achieve the purpose set out in this Privacy Policy. We will not collect any additional data beyond the data listed below without notifying you first.

3. You can opt-out of all data collection and storage, including your account information, email address, and all associated game save data. You can opt-out by permanently deleting all personal data by clicking "Deactivate Account" in Account Settings. This action is irreversible and will remove all associated data from our systems.

Additional Clauses

1. Our service is not directed at children under the age of 16. We do not knowingly collect personal information from children. If we become aware that a child has provided us with personal data, we will delete it promptly.
2. We do not operate an in-app payment processor in this product version; if we introduce paid features through a third party in the future, we will update this policy accordingly. We do not store full payment card numbers on our servers.
3. Our service utilizes third-party mapping services including OpenStreetMap (openstreetmap.org/copyright) and AMap (AutoNavi, a subsidiary of Alibaba Group). In the future, we may also incorporate Mapbox services. Your use of map features may be subject to these providers' respective terms and privacy policies.
4. Where optional AI-assisted features are enabled, limited interaction content may be processed by Hugging Face or other inference providers; their terms and privacy policies apply to that processing.
5. Your data may be transferred to and processed in Australia, United States and Singapore. We take appropriate safeguards to ensure your data remains protected in accordance with applicable regulations including GDPR. By using our service, you acknowledge that your data may be stored and processed on servers located in Australia, United States and Singapore.

Modifications
This Privacy Policy may be amended from time to time in order to maintain compliance with the law and to reflect any changes to our data collection process. When we amend this Privacy Policy we will update the "Effective Date" at the top of this Privacy Policy. We recommend that our users periodically review our Privacy Policy to ensure that they are notified of any updates. If necessary, we may notify users by email of changes to this Privacy Policy.
